It has been announced that the UK Supreme Court will deliver its judgment in the FCA BI Test case on Friday 15 January 2021 at 09:45hrs

Delivery of the judgment may last around 15 minutes. The full written judgment is likely to be published on the Supreme Court’s website very soon after that.

Pending the delivery of the Supreme Court judgment, the FCA published a Consultation Paper on 11 December 2020 (with the consultation period closing on 18 January 2021).

The Consultation Paper took the form of draft guidance upon how the presence of coronavirus (Covid-19) may be proved, based on the High Court’s judgement and declarations, designed to help enable policyholders to receive claim payments as early as possible should the Supreme Court uphold the High Court’s decision that relevant policies potentially provide cover in response to the pandemic.
